Advisor guidance on changes to the EU Settlement Scheme
Following the case of Emma DeSouza, from August 2020 immigration rules will change to allow a “relevant person of Northern Ireland” and their family members to apply to the EU Settlement Scheme, expanding the scheme to a new group of people who were previously excluded.
Through our Immigration Project, we have produced guidance to assist anyone offering frontline advice on the EUSS in understanding and interpreting these changes.
There has been considerable miscommunication and uncertainty over the rights of Irish citizens, relevant persons of Northern Ireland, and their family members in relation to whether they can or should apply to the EU Settlement Scheme. It is essential that this is addressed so that people are aware of their rights and particularly to prevent non-EU family members being left without status in the UK after the EU Settlement Scheme deadline.
