Submission to the Committee of Ministers in relation to the supervision of cases concerning the action of the security forces in Northern Ireland (July 2019)
On the 23 September 2019, the Council of Europe (CoE) Committee of Ministers, which oversees the implementation of the judgements of the European Court of Human Rights (ECtHR), will meet in Strasbourg to consider whether there has been progress in implementing the requirements of a number of court judgments. It is expected that this will include the ‘Cases concerning the actions of the security forces in Northern Ireland’ (also known as ‘the McKerr group of cases’).
The Committee of Ministers will consider both measures related to individual cases and the implementation by the UK state of ‘general’ remedial measures – in particular whether the UK has brought forward the legislation for the Stormont House Agreement (SHA) legacy bodies (which it has not).
CAJ has sent a submission to the Committee of Ministers in advance of their meeting, in which we make a series of recommendations in relation to the implementation of the Stormont House Agreement, the activities of the Police Ombudsman, and legacy inquests.
We also raise issues related to a number of individual legacy cases.
